Das Kantonsgericht Zug hat mit Entscheid vom 14. November 2018 die envion AG, mit Sitz in Baar, gemäss Art. 731b Abs. 1 Ziff. 3 des Schweizerischen Obligationenrechts (OR; SR 220) aufgelöst und ihre Liquidation nach den Vorschriften über den Konkurs angeordnet. Die Rechtsmittelfrist ist inzwischen unbenutzt abgelaufen und der Entscheid ist somit rechtskräftig. Für die Abwicklung des Konkursverfahrens hat das Konkursamt Zug die Anwaltskanzlei Wenger Plattner Rechtsanwälte als Hilfsperson beigezogen.

In einer ersten Phase geht es für das Konkursamt Zug und die Hilfsperson darum, sich einen Überblick über die Verhältnisse zu verschaffen. Gleichzeitig nimmt die Hilfsperson das Inventar über das zur Konkursmasse gehörende Vermögen auf und trifft in Absprache mit dem Konkursamt Zug die zur Sicherung des Vermögens erforderlichen Massnahmen. Die Gläubiger werden zu gegebener Zeit detailliert über das Resultat dieser Abklärungen und Massnahmen orientiert.

Zudem möchten wir Sie darauf hinweisen, dass die Frist für die Forderungsanmeldung erst ab Publikation des Schuldenrufs läuft. Dieser wird zu einem späteren Zeitpunkt erfolgen und auf der Webseite unserer Hilfsperson (www.envion-konkurs.ch), im Schweizerischen Handelsamtsblatt (www.shab.ch) sowie im Amtsblatt des Kantons Zug publiziert. Information regarding the bankruptcy proceedings of "envion AG in Liquidation"

By decision of 14 November 2018, the Cantonal Court of Canton Zug dissolved envion AG, with its registered office in Baar, in accordance with Art. 731b par. 1 n. 3 of the Swiss Code of Obligations (CO; SR 220) and ordered its liquidation in accordance with the provisions on bankruptcy. The appeal period has now expired unused and the decision is therefore final. For conducting the bankruptcy proceedings, the Bankruptcy Office Zug has mandated the law firm Wenger Partner Rechtsanwälte as auxiliary person.

In a first phase, the Bankruptcy Office Zug and its auxiliary shall gain an overview of the situation. At the same time, the auxiliary takes inventory of the assets belonging to the bankrupt's estate and takes the necessary measures to secure them in consultation with the Bankruptcy Office Zug. In due course, the creditors will be informed in detail about the outcome of these clarifications and measures.

In addition, we would like to draw your attention on the fact that the deadline for filing a claim is not until the debt call has been published. This will take place at a later date and will be published on the website set up by our auxiliary (www.envion-konkurs.ch), in the Swiss Official Gazette of Commerce SOGC (www.shab.ch) and in the Official Gazette of the Canton of Zug. If you are a creditor of envion AG, you may however already file your claim now using the "Registration of claims" form.
